1. Acceptance of Terms

By accessing or using CatfishTracker ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Acceptable Use

You agree to use the Service only for lawful purposes. Specifically, you must NOT:

• Upload photos of individuals without their consent, or photos you do not have the right to use.
• Upload photos of minors (persons under 18 years of age) under any circumstances.
• Use the Service to harass, stalk, intimidate, or harm any individual.
• Use results from the Service as evidence in legal proceedings — results are AI estimates only.
• Attempt to reverse-engineer, scrape, or abuse the Service's API.
• Use the Service in connection with any fraudulent or criminal activity.
• Attempt to circumvent usage limits or access controls.

3. AI Results Disclaimer

• Results are provided for informational purposes only.
• Results are not legal evidence and must not be presented as such.
• You must exercise your own judgement and not rely solely on our analysis.
• We are not liable for any decisions made based on the Service's results.

4. Subscription and Billing

• Free plan — 2 AI analysis checks per calendar month, at no cost.
• Pro plan — €4.99/month, billed monthly via Stripe. Includes 20 checks per month.
• Cancellation — you may cancel your subscription at any time from your account settings. Your Pro access continues until the end of the current billing period.
• Refunds — we do not offer refunds for partial months or unused checks. Refunds for technical failures are handled on a case-by-case basis — contact support.
• Unused checks — do not roll over to the next month.
• Price changes — we will give at least 30 days notice of any price changes.

5. Intellectual Property

All content, design, code, and trademarks on CatfishTracker are owned by or licensed to us. You may not reproduce, copy, or distribute any part of the Service without prior written permission. You retain ownership of any photos you upload; by uploading you grant us a temporary licence to process them solely to provide the Service.

6. Limitation of Liability

To the maximum extent permitted by law, CatfishTracker is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or harm resulting from reliance on AI analysis results.

Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

7. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or misuse the Service. We will generally provide notice unless immediate termination is required to prevent harm.

8. Changes to Terms

We may update these Terms from time to time. Significant changes will be notified via email or an in-app notice at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.

9. Governing Law

These Terms are governed by the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Austria. If you are a consumer in another EU member state, you retain the right to bring proceedings in your country of residence.
